A Power of Attorney is needed or
required under the following circumstances:
a)
Where
the donor is unavailable either as a result of being abroad or physically away;
b)
Where
the donor is busy as a professional;
c)
Where
the donor is suffering from ill health or some form of physical impairment;
d)
Where
there is need to secure the interest of a purchaser of landed property pending perfection of title;
e)
Where
expert skill is required. Example, in cases of Patent and Trademark Registration and Estate/Property Management;
f)
Where
a representative actions is contemplated – example actions by Family Heads on
behalf of the other members of the family;
g)
In
the case of mortgage by sub-demise, where there is need to enable the mortgagee
have the power of sale.
